Quinnette was also on active parole and will most likely face an additional charge of violation of parole, Cardoza said.

The officer, Gonzalez, who shot Quinnette had stopped another person unrelated to the events that followed. While talking to the initial pedestrian, Gonzalez noticed Quinnette in the distance behaving suspiciously around a vehicle, then walking away.

Gonzalez called in the license plate of that vehicle and learned it was reported stolen.

After notifying dispatchers of the second suspect, Quinnette, Gonzalez found him about a block away when Quinnette ran and Gonzalez pursued on foot.

After about a 200- to 300-foot pursuit, Quinnette stopped, turned around and reached into his belt area and pulled out what appeared to be a handgun and pointed it at Gonzalez, Cardoza said. It later turned out to be a BB gun, but Gonzalez was unable to determine that at the time and reacted to protect his own safety, Cardoza said.

Gonzalez fired one shot, hitting Quinnette in the thigh. Quinnette received first aid treatment before being taken to Santa Clara Valley Medical Center, where he was treated and released to deputies and taken to the county jail, where he is now.
